Terms of service

A completed "Vacation Rental Agreement" is required within 24 hours to hold your reservation. The Rental Deposit of 50% is due upon receipt. Review and acceptance of the Palmetto Prestige Vacations’ Terms & Conditions, which is made part of this Rental Agreement, is required before a confirmation will be issued.

To provide our guests with the best vacation possible, we ask that the Guest notify the Palmetto Prestige Vacations property management team in writing and preferably with pictures of any issues, damages, or if the integrity of the house is affected including but not limited to: appliances, walls, doors, furniture, or any structure in or on the property so the host can address and fix the problem immediately. This includes any broken, dented, cracked, or stained items during the stay. We ask that you allow us to immediately remedy these items.

An active credit card is required to maintain the reservation and the integrity of the unit.

  1. Vacation Rental Agreement- (THIS IS NOT A LEASE) This is a vacation rental agreement for a temporary vacation stay at a managed vacation rental property. THIS AGREEMENT IS NOT A LEASE AND CONVEYS NO RIGHTS IN REAL PROPERTY. By agreeing to these Terms & Conditions, you stipulate and agree that you have not and will not receive a real property interest in or rights to the vacation rental property.

    Guest agrees to abide by all rules and regulations contained herein or posted on the premises related to the Rental Property. Guest obligations include but are not limited to keeping the premises as clean and safe as the conditions of the premises permit and causing no unsafe or unsanitary conditions in the common area and remainder of the premises that Guest uses.  Guests agree not to use the premises for any commercial activities or purpose that violates any criminal law or governmental regulation.  Guest's breach of any duty contained in this paragraph shall be considered material and shall result in the termination of guest occupancy with no refund of any kind. The guest shall allow the host (or his designee) access to the property for purposes of repairs and inspection if required. The host shall exercise this right of access in a reasonable manner.

  2. Occupancy: In no event shall the Rental Property be occupied by more persons than the capacity of the property as stated on the website or the confirmation letter, without prior approval by Owner. People other than those in the Guest party set forth may not stay overnight in the property. Any other person on the property is the sole responsibility of Guest.

    Our customary policy is no reservations will be made to students or singles under the age of twenty-five. Parents must accompany their children under the age of twenty-five at all times. This policy includes reservations made by parents who do not check-in, and/or who leave overnight during the length of the stay. No Exceptions!

    We require one parent for every four persons under the age of 25. Non-compliance with these rules and regulations will result in immediate eviction with no return of any and all funds paid. Any reservation obtained under false pretense will be subject to forfeiture of advance deposit payment and/or rental money, and the party will not be permitted to check in.

  3. No underage drinking and/or partying allowed. Our rental properties are monitored for violations of this policy. No fraternities, school, civic, or other non-family groups are allowed unless Owner grants prior approval. In no event shall Guests assign or sublet the Rental Property in whole or in part.  Violations of these rules are grounds for expedited eviction with no refund of any kind.  Guests hereby acknowledge and grant specific permission to Owner to enter premises at any time for inspection purposes should Owner reasonably believe that Guests are causing or have caused any damage to Rental Property.  Guest further agrees to grant Owner access to Rental Property for purposes of maintenance and repair.  If listed "For Sale", Guests agree to grant access by scheduled appointment upon notification.

  4. Payment Schedule: A payment of 50% is taken by Owner at the time of the booking.  Any remaining balance must be paid 30 days before the arrival date, or this Agreement may be cancelled by the sole option of the Owner.  An automatic credit card payment for the remaining balance will be scheduled by the Owner to be made 30 days prior to the arrival date.  The credit card of the first payment is used if a credit card was provided.  If the automatic payment fails for any reason, it is the responsibility of the Guest to make sure that the remaining balance is promptly paid in full, or the reservation will be canceled with no refund of payments already made.  All policies contained in this Agreement shall apply equally to payments made by credit card via website. Any refunds due to Guests from a credit card payment will be refunded by credit card transaction.

  5. Security Deposit: A security deposit is required ("Security Deposit") and will be automatically reserved for the booking.  The automatic reserve is conducted by putting a hold or charge on the Guest's credit card for the amount of $500.00 exactly 2 day(s) prior to the arrival date.  The credit card of the last successful payment will be used.  If there are no successful credit card payments, it is the responsibility of the Guest to send $500.00 by check to the Owner to satisfy the Security Deposit requirement.  If, at the end of the rental period, the rental property is returned undamaged beyond normal wear and tear, the Security Deposit will be released in full within 5 days.  In the event of any damages, Owner will provide Guest with a full accounting of expenses incurred and itemized deductions made from the Security Deposit.  Should the damages exceed the amount of the Security Deposit, Guest agrees to pay the balance within 7 business days after receiving notification. Deductions from Security Deposit may include, but are not limited to: excess cleaning fee, hot tub/pool draining and refilling fee, trash removal fee, missing item replacement costs, damaged item replacement or repair costs, repair costs of buildings or grounds, damage to premise, mailing of personal items (see Lost & Found), or other service call fees.  Owner is under no obligation to use the least expensive means of restoration. By signing this Agreement you waive your right to dispute any charges that are made to your credit card regarding this policy including filing a dispute charge with your credit card banking institution.

  6. Theft/Damage: We have a detailed inventory of all furniture, décor, electronics, linens, etc. as well as pictures and video of the entire home and will do an inventory check at the end of each stay. Please respect our property and do not attempt to leave with something that is not yours. We will gladly tell you where you can purchase particular items you may like in the home.

  7. No Professional or Commercial Use: No professional photo shoots are allowed without written permission from the Owner. If you're interested in having a photoshoot, please contact us first for a discussion. Unauthorized use of the rental property name or images of the property, exterior, surroundings, or interior for use in the selling, advertising, marketing, and/or promotion of any product or business or used in any TV or film production is unlawful and will be pursued with appropriate legal action.

  8. Regular payments and security deposits for the booking will be displayed as  “PALMETTO PRESTIGE VACA” on the Guest's credit card statement.

  9. Pets: Guests must obtain permission from the Owner to have pets on the Rental Property if Rental Property permits them. If permission is not given by the Owner, any pet(s) found in or about the Rental Property will be grounds for expedited eviction and forfeiture of all monies paid.

  10. Children: Guests must inform the Owner of their intention to bring children and the specific number. A child is defined as any person under the age of 18.

  11. Cancellation/Refund Policy: Full refund for cancellations from 24 hours of booking or up to 60 days before check-in and 50% refund for 30 days of fewer. If booked fewer than 30 days before check-in, there will be no refund. We highly encourage Guest to purchase travel rental insurance. Palmetto Prestige Vacations does not issue refunds due to acts of nature or measures beyond our control such as: weather (see below for Severe Weather Policy exceptions), power blackouts, internet outage, water shortage, flooding, snow, construction at adjacent properties, road conditions, security, travel warnings, flight or travel changes, pandemics, political unrest, or any other acts of god or nature. In the event the rental property is rendered unfit for occupancy or use, this Agreement may be terminated by Palmetto Prestige Vacations and Guest will be provided a full or pro-rated refund for the time the rental property was not used. If the Guest has other potential renters, Palmetto Prestige Vacations has the right to approve/deny the replacement group before accepting the reservation. In the event the Guest needs to cancel his or her reservation and applies to a refund, the funds will be sent back to the Guest in the same manner they were received.

    Certain extenuating circumstances may apply to accepting cancellations outside of these terms. In these cases, it is up to the discretion of the Owner of the property or the following severe weather policy below. For all inquiries regarding extenuating circumstances please contact Palmetto Prestige Vacations property management team via your preferred booking app or email.

    Severe Weather Policy:
    Our severe weather and Extenuating Circumstances Hurricane Policy is as follows:

    If a Mandatory Evacuation Order is issued by the Governor of SC specifically for the county in which your property is located for the dates of your stay, the extenuating circumstances policy will be in effect. In this case, we will refund any deposits or payments paid by the guest and we shall have no additional liability concerning the reservation.

    However, if a Mandatory Evacuation Order is NOT issued by the Governor of SC, then the standard cancellation policy will still apply and no refund will be issued. This is the case even if the guest chooses to cancel or travel is disrupted due to the storm.

    Additionally, if there is an adverse weather phenomenon outside of Hilton Head Island or SC (ie. other regions of the US or abroad) during the dates of the guests' stay which hinders the guests from traveling to the property, the standard cancellation policy will still apply. Therefore, a refund will NOT be issued. Hurricane season is during the months of June-November.

  12. Additional Refund Information: No refunds will be provided due to inoperable appliances, pools, hot tubs, elevators, reasonable construction or maintenance, etc.  The Owner will make every reasonable effort to ensure that such appliances will be and remain in good working order. 

  13. Lost & Found Items: Guest is responsible for all shipping costs for any Lost and Found items that Owner is requested to return to Guest with an additional $35 service charge. Items found and not claimed within 30 days will be disposed of at the discretion of Owner.

  14. Pool/Hot Tub: If a hot tub or pool is provided at the Rental Property, it will be professionally prepared and tested for proper and safe chemicals at all times. Misuse of a hot tub or pool by the spilling of foreign substances into the pool, i.e. soap, shampoo, oils, glass or metal will result in a Service Call Charge at the sole discretion of Owner. Under no circumstances are pets allowed in pools or hot tubs. Violation of this provision shall be grounds for expedited eviction and forfeiture of all monies paid. By using the pool and hot tub, Guests agree to hold both the property owners and Palmetto Prestige Vacations harmless for any injuries, accidents, or incidents that may occur, and they accept full responsibility for ensuring the safety of all users and for any damages caused to the pool, hot tub, or surrounding areas during their stay.

    Diving or jumping into the pool or Jacuzzi may result in head, neck, or spinal injuries. As the renter, you accept the risk of the pool and specifically agree that no minor will swim in the pool unaccompanied by an adult. The pool is cleaned twice per week during peak season and once during other times but doesn't take more than a half-hour. Please allow the pool service tech to do his job if he arrives when you are there. Community or condominium pools and/or jacuzzis are not controlled or maintained by Palmetto Prestige Vacations; therefore, we cannot be held responsible for inconveniences resulting from the pool.

    Some pools offer a gas heater; therefore, there is a fee to heat the pool. Pool heat is offered year-round; however, is dependent on outside temperatures, pools cannot be heated if the temperature is below fifty-two (52) degrees or above eighty (80) degrees. If you are interested in adding pool heat it must be ordered and paid for at the time of booking. Please note that the heating of the pool and spa cannot be guaranteed. While we make every effort to ensure that the pool and spa are heated to a comfortable temperature, there may be circumstances beyond our control that prevent this from happening.

  15. Linens or towels: They are supplied with the Rental Property, Guest is responsible for lost or damaged (including soiled, stained, torn) items at the cost of replacement value for such damaged or lost linens or towels.

  16. In the event Owner is unable to make Rental Property available for any reason other than described above or a reasonable substitute as determined by Owner, Guest agrees that Owner's sole liability as a result of this unavailability is to provide a full refund of all monies paid under this Agreement and Guest expressly acknowledges that in no event shall Owner be held liable for any special or consequential damages which result from this unavailability.  Guest also agrees to indemnify Owner from and against liability for injury to Guest or any other person occupying Rental Property resulting from any cause whatsoever including, but not limited to, injury sustained as a result of use of the phone, spa, hot tub, sauna, whirlpool tub, pool, exercise equipment, elevator, etc. except only such a personal injury caused by the gross negligence or intentional acts of the Owner.

  17. Owner may terminate this Agreement upon the breach of any of the terms hereof by Guest.  Guest shall not be entitled to the return of any rental monies paid under the terms of this Agreement and shall vacate the Property immediately.

  18. Agreement shall be enforced under the laws of the state within which the Rental Property is located, including any applicable rental acts of that state, and represents the entire Agreement.  Any amendments must be in writing and signed by both parties.  In the event of a dispute, legal action may only be instituted in the county within which the Rental Property is located.  If any part of this Agreement shall be deemed unenforceable by law, that part shall be omitted from this Agreement without affecting the remaining Agreement.

  19. The Rental Property may offer access to recreational and water activities, including but not limited to canoes, bicycles, and swimming.  Guest fully understands and acknowledges that outdoor recreational and water activities have inherent risks, dangers, and hazards.  Participation in such activities and/or use of equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death, or other ailments that could cause serious disability.  Guest agrees to fully indemnify and hold harmless the Owner and any and all agents, employees, or contractors for any injury or damage caused by these activities, whether caused by the negligence of the Owners, the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes foreseeable or unforeseeable.  Guest hereby assumes all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the Owners or by any other person.  Guest hereby voluntarily agrees to release, waive, discharge, hold harmless, defend, and indemnify Owner and any and all agents, employees, or contractors from any and all claims, actions, or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of Rental Property facilities, equipment, or activities.  Guest further assumes full responsibility for the actions of any and all persons whom he may allow to enter the property during the rental period and indemnifies Owner from any and all claims arising from such other persons.

NOW, THEREFORE, in consideration of the mutual agreements and covenants herein contained, Guest has read and agreed to the following:

I understand the rules and rental conditions upon which I am agreeing to rent accommodations, equipment, and use of the property.  I acknowledge and accept that the sole responsibility for safety lies with the participant.  In agreeing to this, I acknowledge that outdoor activities and exposure to the natural elements and animals can be dangerous and sometimes result in injury and even death.  Steps and decks can be slippery, animals and insects can threaten and infect or injure, exposure to the elements can cause hypothermia, sunburn, among other risks inherent in participating in camping, outdoor, and water activities.  I know that alcohol and/or drugs do not mix safely with any outdoor activity.

I am over the age of 25 and assume responsibility for all in the Group, and the Group is visiting the property and using the equipment and is engaging in activities or events at the Group's risk.  I hereby assume all legal responsibility for bodily injury to me or to any person on the property as a result of my visit and use, operation, or possession of equipment hired or loaned to me.  Acknowledging this, I accept complete responsibility for the Group, and the Group is visiting the property using the equipment and is engaging in activities or events at the Group's risk.

I will abide by the rules and accept these rental conditions:

  • The property I rent will be returned in the same condition in which it was rented and I will be responsible for all damage and/or loss that occurs during my rental period.

  • I agree to hold harmless and to indemnify the Owner of the Rental Property against all loss, damage, expense, and penalty on account of personal injury, pets, or property damage to the rental dwellers, the undersigned, or to any minor child or children in the charge of the undersigned, howsoever arising, whether by act or acts or failure to act of the employees, owners or animals of the said company or property owners or not.

  • I acknowledge receipt of the property in good order and condition (if found otherwise per my arrival I will contact Owner immediately) and further agree that the Owner of the Rental Property shall not be liable for consequential damages of any kind or nature from whatever cause arising, whether property or equipment is loaned or rented.

  • I enter into this agreement freely with the Owner of the Rental Property at my own risk, acknowledging the risks inherent in indoor and outdoor activities, and assume any and all responsibility for the minor children and myself in my charge.

  • All parties agree to and will comply with Federal, State, and County pollution laws and any other applicable laws and regulations.

Other Information/House Rules: 

  1. Arrival/Check-Out Instructions: The address, door code, house manual, etc. will be automatically sent 48 hours before check-in. Check-out Instructions will be sent 48 hours before check-out, please be on the lookout for these emails. Failure to check or read email does not warrant the exclusion of instructions/rules.

  2. Mail: We do not have access to the mailboxes at the properties; therefore, anything delivered via USPS will not be able to be retrieved.

  3. Insurance: We strongly advise purchasing travel insurance to protect your vacation. Insurance options are available at the time of booking and some plans remain available until 30 days (thirty) prior to Arrival. Travel insurance is offered through a 3rd party company. We strongly advise you to purchase the policy that works best for you. 

  4. Non-Smoking Policy: All of our properties enforce a strict non-Smoking or Vaping policy. Any presence of the smell or paraphernalia will result in an automatic forfeit of the security deposit.

  5. Noise: Guests should not create excessive noise at a level that disturbs neighbors. Code-enforced neighborhood quiet hours are from 10:00 PM - 8:00 AM Music played inside may not be heard outside of the property with the doors and windows closed. At 10:00 PM, all guests not staying at the property need to depart from the premises.

  6. Parking: Parking is limited to what each property driveway/garage is able to hold. Vehicles are to be parked in the paved driveway and garage (if applicable) only. There is no Parking on the grass, pine straw, or in the road or street. Community Security Associations strictly enforces this violation and actively drives around to monitor. The guest will first be issued a warning and then a fine. Guest is responsible for paying any parking violation fines issued by the Resort Associations. Additional cars will need to be parked off-site and motor homes, motorcycles, trailers, or boats are not allowed and will be towed and or fined.

  7. Car Passes: Sea Pines vehicles are required to purchase a gate entry pass upon arrival at Sea Pines. The passes are $9 per day/$20 per week and are subject to change by Sea Pines at any time. They only accept cash. Take your receipt to any Sea Pines Resort-owned restaurant for a discount on your bill.

  8. Charcoal Grills: Are not allowed at any property per order of the Town of Hilton Head and the Town of Hilton Head Fire Department.

  9. Housekeeping: All homes are cleaned prior to your arrival. There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. However, we do offer a prior coordinated mid-stay clean for an additional fee if you would like one. Any excessive cleaning required during or after a Guest's stay will be determined by the property manager and charged to the Guest's credit card on file

  10. Garbage: Any garbage must be stowed in the proper garbage or recycling receptacle, located on the side of the homes. Please ensure all trash is put in a kitchen-sized trash can and individual trash pieces are not thrown into the receptacles. Pick-up days can be found in the house manual. Do not take the trash cans to the street, all homes have curbside pick-up.

  11. Home Equipment: All properties are equipped for basic vacation needs. Linens are provided for the maximum number of guests stated for each home. Our kitchens come fully stocked with a variety of pots and pans, crockpot, griddle, baking pans, Keurig coffee maker, and a traditional filter coffee maker. All homes include a starter set of garbage bags, paper towels, toilet paper, tissue, dish, clothing and dishwasher detergent, body wash, shampoo, conditioner, hand soap and MORE! Starter sets are meant to get you started! They typically last 1-4 days. It is the responsibility of the guest to purchase anything additional that is needed during the stay. Most homes are equipped with 3-6 beach chairs and one beach towel for each Guest

  12. Internet: An illegal or abusive use of the Internet access is not allowed. Permission must be given from the host to download or purchase any movies on the TV. Privacy & terms usage for properties with internet access. Users/guests may not use the internet access contained in or around for malicious or unethical activity, including assessment of other people over the internet or that violates federal, provincial, or copyright laws. This act, in conjunction with the Digital Millennium Copyright Act. Any and all misuse that is reported will be dealt with swiftly. The Guest that is listed on the reservation is ultimately responsible for the guest's/family member's actions during the duration of their stay. All of our properties have internet access through their individual service providers. We do not, however, guarantee internet connectivity due to service being provided by an outside vendor, restrictions from personal computers, and several other factors that may lead to interruption of internet service. In the event the internet service is inoperable, we will do our best to troubleshoot over the phone, but if it requires further assistance, the Guest will be responsible for contacting the internet provider. No refunds will be given due to the loss of internet service

  13. EV Charging Outlets: Are available at select properties.

  14. Rates/Pre-payment: Published rental rates are subject to change without notice. We reserve the right to correct rates that may have been misquoted due to human and/or computer error. Reservations can be made up to one (1) year in advance; however, rates and properties are not guaranteed. Rates and properties are subject to change without notice

  15. Taxes: Published nightly rental rates do not include South Carolina State and Hilton Head local taxes totaling 11%. South Carolina requires us to collect 8% of the rental and cleaning fee. The Town of Hilton Head requires us to collect 3% of the rental and cleaning fee.

  16. Owner’s Closet: All properties have interior locked closets that are off-limits to guests. Tampering with these doors, locks, and causing damage to them will result in a repair charge and charges for anything taken.

  17. Check-Out Instructions:

    1. Please put all dirty bath linens and stripped bed linens on laundry room floor. Start a load of beach towels if used just prior to leaving. Do not mix colored beach towels with any other linens.

    2. Please take out all garbage from kitchen and bathrooms. Ensure all trash is properly put in a kitchen-sized trash bag before putting in the receptacle bins. Individual pieces of trash thrown in bins will not be taken by the trash company.

    3. Properly wash all dishes, dry, and return to their original place. Start dishwasher on express cycle for any last-minute dishes.

    4. Empty and dispose of all used food items in fridge, freezer, and pantry including any kitchen items bought and used during stay. Please do not leave behind anything- including plastic cutlery, condiment packets, napkins/plates, ice bags, spices, etc.

    5. Return all furniture to it’s original locations to avoid additional charges. Please refer to listing photos if needed.

    6. Please spray down all used beach/pool equipment and return to the same location where you found upon arrival. 

    7. Please clean the grill if it is used.

    8. Please turn all interior and exterior lights off and lower shades.

    9. Please lock ALL doors and windows if open.

    10. If any pets, clean up feces, pet hair, and dispose. Any excessive hair/feces/stains left behind will be charged. Dog feces will need to be put into a kitchen-sized trash bag as well. Vacuum/lint roll couch or decorative pillows if needed.
